iViTAR2b <br />BOOK rSCE466 <br />To ensure that the project's designed stormwater management system <br />will not discharge stormwater into the North Relief Canal, staff <br />proposes that the following clause be added to the last sentence <br />of condition #11 of the D.O.: <br />"Under no circumstances shall post -development runoff volumes <br />exceed pre -development runoff volumes, nor shall stormwater be <br />discharged from the site into the North Relief Canal, for a storm <br />event of three-day duration and 25 -year return frequency". <br />°Construction Deadlines <br />The originally proposed D.O. established three construction <br />deadlines: a three-year (1992) deadline for commencement of any <br />portion of the project; a December 31, 1993 deadline for <br />commencement of the mall; and an estimated December 31, 1996 <br />deadline for total project completion. The Board expressed the <br />desire to specifically ensure reasonable construction progress of <br />the mall and to ensure that development of the commercial out - <br />parcels outside of the area along U.S. #1 currently zoned <br />commercial did not precede development of the mall. <br />Staff proposes a complete "re -write" of condition #2, which <br />provides for the following: <br />1. a three-year deadline for commencement of construction for <br />some portion of the project: either an outparcel/residential <br />area or the mall [Condition 2.a.]; <br />2. development of the residential area or the commercial out - <br />parcels located within the current commercially zoned area <br />along U.S. #1 prior to commencement of mall construction <br />[condition 2.b.1]; <br />3. a prohibition on issuing building permits for construction on <br />commercial outparcels located outside of the currently <br />commercially zoned area prior to completion of at least 50% <br />of the mall's foundation system [condition 2.b.2.]; <br />4. a December 31, 1993 deadline for commencement of mall con- <br />struction for at least 320,000 square feet of building area <br />[condition 2.c.1.]; <br />5. a 210 day maximum time period for the completion of the mall <br />foundation system from the date mall construction begins, <br />whatever the date may be [condition 2.c.2.1; <br />6. a 24 month maximum time period for the completion of the mall <br />foundation, exterior walls, and roof from the date mall <br />construction begins, whatever the date may be [condition <br />2.c.3.]; and <br />7. an "Act of God" clause that allows for extension of the <br />foundation and "shell" construction deadlines due to dis- <br />ruptive events beyond the developer's control. <br />All numbers used in the revised conditions were derived from staff <br />research and input from the developer. Staff and the developer <br />are in agreement on the revisions; and, in staff's opinion, the <br />revisions address the Board's expressed concerns. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt the <br />revised development order. <br />26 <br />
