PUBLIC HEARING - HARBOR TOWN CENTER REVISED DEVELOPMENT ORDER <br />Continued from the BCC Meeting of March 14, 1989 <br />The Board reviewed the following memo dated 3/17/89: <br />TO: James E. Keatin , A <br />Community evelo men Director <br />FROM: Stan Boling, AICP <br />Chief, Current Development <br />DATE: March 17, 1989 <br />SUBJECT: REVISED DEVELOPMENT ORDER FOR THE HARBOR TOWN CENTER <br />D.R.I. <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of March 28, 1989. <br />BACKGROUND AND CONDITIONS: <br />At its regular meeting of February 28, 1989, the Board of County <br />Commissioners voted unanimously to "conceptually" approve the <br />Harbor Town Center development order (D.O.) subject to some <br />language changes to be finalized and approved at the March 14, <br />1989 Board meeting. At the developer's request at the March 14th <br />meeting, the Board postponed the item which is now to be heard at <br />the March 28, 1989 meeting. <br />Taking into consideration the concerns and ideas expressed by the <br />Board at the February 28th meeting, staff researched alternatives <br />and produced several "working draft" iterations that were reviewed <br />and commented upon internally and by the applicant and its agents. <br />Staff now proposes revisions to the D.O. that have been fully <br />agreed to by the developer. <br />ANALYSIS: <br />Although the Board discussed and clarified several items within <br />the D.O. regarding landscaping/open space, bumper stops, drainage, <br />utilities, and fire protection, it was concluded that only two <br />issues needed to be more adequately addressed via revisions to the <br />D.O. These two areas relate to stormwater discharge and construc- <br />tion deadlines. <br />°Stormwater Discharge <br />Although the ADA includes an acknowledgement by the applicant that <br />the project is not within the Indian River Farms Water Control <br />District and that the project cannot legally and will not be <br />designed to discharge stormwater into the North Relief Canal, <br />nothing in the originally proposed D.O. specifically prohibited <br />discharging into the Canal. (It was verified by the Public Works <br />director that the developer may be able to obtain a legal positive <br />outfall to the Indian River, with all applicable stormwater <br />quality standards being met.) <br />25 <br />MAR 2 8 1989 <br />LINN <br />
