ORDINANCE NO. 89- 11 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING <br />THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP <br />FROM RM -6, MULTI -FAMILY RESIDENTIAL DISTRICT TO OCR, <br />OFFICE, COMMERCIAL, RESIDENTIAL DISTRICT; FOR THE <br />PROPERTY GENERALLY LOCATED AT THE SOUTHWEST CORNER OF <br />U.S. HIGHWAY #1 AND 73RD STREET, AND DESCRIBED HEREIN, <br />AND PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, The Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, The Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinaftezz described property; and <br />WHEREAS, The Board of County Commissioners has determined <br />that this rezoning is in conformance with the Land Use Element of <br />the Comprehensive Plan of Indian River County; and <br />WHEREAS, The Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners: of Indian River County, Florida, that the Zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />That part of the N. } of the NE 1 of the SW 1 of Section 3, <br />Township 32 South, Range 39 East, lying West of the west <br />right-of-way line of U.S. Highway #1 (S.R. #5). Less that <br />part lying West of the West R/W of FEC. Railroad and also <br />less Rights of Way of record. Said land lying and being in <br />Indian River County, Florida. <br />Be changed from RM -6, Multi -Family Residential District, up to 6 <br />units/acre to OCR, Office, Commercial, Residential District. <br />All with the meaning and intent and as set forth and <br />described in said Zoning Regulations. <br />Approved and adopted by the Board of County Commissioners of <br />Indian River' County, Florida, on this llth day of April <br />1989. <br />This ordinance was advertised in the Vero Beach <br />Press -Journal on the 21st day ofMarch , 1989, for a public <br />hearing to be held on the llth day of A ril , 1989, at which <br />time it was moved for adoption by CbmmissionerEggert <br />seconded by Commissioner Scurlock , and adopted by the following <br />vote: <br />26 <br />APR 11 1999 <br />L <br />floor 76 w,r 542 <br />
