Commissioner Scurlock suggested that this might be a <br />permitted situation, and Director Keating felt the difficult <br />thing with that is setting the criteria because the flexibility <br />may give you a more landscaped look that would be more <br />appropriate for U.S.#1. <br />Further discussion took place on opacity, and Commissioner <br />Scurlock asked how we would handle the places where there is not <br />a lot of high growth, and Director Keating said the Plan would <br />apply only when you were removing any exotics. <br />Commissioner Bird asked how they would measure 70% opacity, <br />and Mr. DeBlois admitted that to come up with an exact percentage <br />of opacity is difficult, but without setting some sort of density <br />reference, it would be very difficult to set a standard for the <br />Trail. The main objective is the opacity as viewed from Jungle <br />Trail, and the feeling is that it would be reviewed by a board. <br />Commissioner Eggert also questioned the fencing <br />restrictions, and asked how the 10 ft. fencing restriction <br />affects what is there now. <br />Director Keating explained that this Plan will not affect <br />anything that is there. However, more requests will be coming <br />before the P & Z and this will pretty much set the parameters. <br />The issue is whether we want to try to keep the buffer area <br />natural and to what extent do we want to allow structure <br />encroachments. A compromise was reached during the workshops <br />whereby fences would be allowed in the outer 10 -ft. Basically, <br />he felt it is an aesthetics consideration. <br />Commissioner Eggert assumed that a variance request would go <br />through the regular process of being heard by the P & Z <br />Commission, but asked if there would be an appeal to the County <br />Commission. <br />Assistant County Attorney Bill Collins advised that as a <br />general rule, any of our variances that are granted by the Board <br />of Adjustments, or in this case, the P & Z Commission, the appeal <br />APR 11 1989 <br />34 <br />POOK <br />9 J PACE 5 0 <br />
