l'" <br />APR 11 1989 <br />BOOK <br />76 PAGE 540 <br />50% or even 1O%, and was concerned about the question of grand- <br />fathering because he felt we want to protect everybody's rights <br />including those people who have invested in property along the <br />Trail. <br />Commissioner Eggert felt that 70% opacity is too great, and <br />noted that the first paragraph on page 6 of the management plan <br />states that plants a minimum of 7 feet tall are to be located <br />within 10 feet of the trail. She felt the Commission spoke to <br />that when we were reviewing Sea Oaks and determined that as long <br />as that 30 feet was taken care of, we didn't want 7 -ft. tall <br />plants within 10 feet of the Trail. <br />Commissioner Bowman suggested that it read that tall <br />plantings will be interspersed within the 30ft. buffer. She felt <br />that would cover it, and Commissioner Scurlock agreed. <br />Commissioner Bowman felt there has been a general <br />misperception of just what a jungle is. A jungle suggests an <br />uncontrolled dense tangle, and she suggested that several vines <br />be added to the suggested plant list. <br />Commissioner Eggert wished to return to Item (g) on Page 6 <br />of the Plan where it states that "no native vegetation should be <br />altered, pruned, etc." Basically, she agreed with that, but <br />felt there might be times when we could allow taking out more <br />than just the dead portions. She didn't want this to get so set <br />in cement that you couldn't do any kind of pruning. It seemed to <br />her that this was in contradiction with the mangrove restrictions <br />where we allow some cutting on their being absolutely dead. <br />Commissioner Bowman felt we should have an exception for <br />mangroves because we have a mangrove ordinance. <br />Robert Keating, Director of Planning & Development, noted <br />that mangroves can be trimmed under very strict requirements, but <br />Commissioner Eggert felt that there may be some cases where it is <br />necessary to prune, say if there is a massive rat nest, etc., and <br />she had a problem saying that no pruning would be allowed, <br />period. <br />33 <br />
