APR 11 1989 <br />ROOK 76 P cE 5 m <br />There being no others who wished to be heard, Chairman <br />Wheeler closed the public hearing. <br />Chairman Scurlock wanted to try a Motion that we adopt the <br />management plan as submitted to us by staff with the changes that <br />staff has made in reference to the lighting and the other <br />language presented. In addition to that, he would like to modify <br />the language under the realignment section to allow a broader <br />basis for any realignment by tying that very specifically to that <br />so it could not jeopardize the integrity of the historical nature <br />of the Trail. He also wished to change the opacity requirement <br />to 60% and allow the trees and plants to be dispersed through the <br />30 -ft. area as opposed to just a hedge -like effect. He also <br />wished, at the request of Mr. Dean, to add to the management plan <br />the restrictions on lighting to make sure that the lighting is <br />compatible with the trail. A fourth item would be that instead <br />of having the roadway donated or -given fee simple, it be donated <br />right-of-way. <br />Commissioner Eggert asked if Commissioner Scurlock would <br />consider allowing some carefully controlled maintenance, but <br />Commissioner Scurlock didn't wish to modify the plan any further <br />at this time. He felt the proper approach, in terms of the <br />opacity issue and maintenance, would be to modify the plan as we <br />move along, because he believed we really should move towards <br />some sort of structure that allows not only for the policing, but <br />also some ability for staff to actually issue a permit for any <br />major modification to vegetation along there. Commissioner <br />Scurlock believed we should move the plan ahead today, get it <br />adopted, and then modify it as we move along. <br />Commissioner Eggert asked if his Motion included any <br />requests for variances coming to the Board of County <br />Commissioners, and Commissioner Scurlock agreed to add that to <br />his Motion. <br />51 <br />
