MOTION WAS MADE by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, that the Board adopt Resolution <br />89-36, approving the Jungle Trail Management Pian with <br />the changes submitted by staff plus the following <br />modifications: <br />1) Change the opacity requirements to 60%; <br />2) Trees and plants be allowed to be dispersed <br />through the 30 -ft. area, as opposed to just a <br />hedge -like effect; <br />3) Place restrictions on lighting to make sure that <br />the lighting is compatible with the Trail; <br />4) That the roadway be dedicated right-of-way rather <br />than given fee simple; and <br />5) That variances be appealed to an elected board, <br />rather than to a Judge. <br />Under discussion, Commissioner Bird felt that if it is our <br />ultimate goal to achieve 60% opacity, someone should be able to <br />trim their plants to maintain 60% opacity, because otherwise it <br />is going to be 100%, and Commissioner Eggert agreed. <br />Commissioner Scurlock believed we need to take one step <br />further because there are going to be areas within the entire <br />length of Jungle Trail where we honestly do not want 60%. There <br />are areas where we might want a higher percentage of opacity. He <br />really felt that needs to be addressed in a more comprehensive <br />way than we are able to today, but he wished to go with 60% today <br />so that we get a plan implemented, and then we can start fine <br />tuning it. _ <br />Commissioner Bird asked if the Motion included something <br />about the fence issue, but Commissioner Scurlock stated that he <br />remains moot on the fence issue because he didn't think the <br />grandfather issue should take root any place.
