McCoy i ,' <br />� <br />Staff PlannerCurrent Development. <br />DATE: <br />SUBJECT: RAY SMITH AND CECIL JOHNSON"S REQUEST FOR RIGHT OF WAY <br />ABANDONMENT <br />April 10, 1989 <br />It is requested that the data herein presented be given formal <br />consideration -•by the Board of County .Commissioners at its regular <br />meeting of April 25, 1989. <br />DESCRIPTION AND CONDITIONS: <br />Ray Smith and -Cecil Johnson have submitted a petition for abandon- <br />ment of 85th Place between C.R. 510 and 46th Avenue. Per guide- <br />lines established b* the Board of County Commissioners, the <br />petition was reviewed by all County divisions and utility provid- <br />ers having jurisdiction within the right-of-way. All reviewing <br />agencies have recommended approval of the abandonment, with the <br />provision that 35' drainage and utilities easement be retained, <br />centered in the subject right-of-way. This portion of 85th Place <br />is not part 'of the roadway system as noted on the County Thorough- <br />fare -Plan, and is not needed for the thoroughfare system. <br />The right-of-way is presently unused and wooded. The applicant is <br />requesting that this right-of-way be abandoned to facilitate the <br />commercial development of blocks 10 and 11 of the WEONA PARK <br />SUBDIVISION. <br />RECOMMENDATION: <br />Staff recommends that the County Abandon its rights to 85th Place <br />and that the Chairman of the Board of County Commissioners be <br />authorized to execute the attached resolution (Attachment #3), <br />with the following condition: <br />1. A 35' drainage and utilities easement be retained centered in <br />the subject'right-of-way. <br />2. Prior to the Chairman signing the <br />Resolution abandoning the r/w:; <br />the applicant shall file a unity <br />of title that is acceptable to the <br />Co. Atty's office, that unifies <br />all properties ly!ng south and <br />east of CR 510 in Blocks 9 and 10 <br />of the Weona Park Subdivision that <br />are under the control of the <br />.applicant <br />APR 2 51989Doo, <br />25 76 F.A .05 <br />
