Pr" <br />APR 2 51989 <br />BOOK 76 rAGE. 678 <br />The Board of County Commissioners granted conceptual PRD plan <br />approval for the overall subdivision on August 25, 1988. At its <br />regular meeting of September 10, 1987, the Planning and Zoning <br />commission granted preliminary PRD plat approval to the Garden <br />Grove PRD. Subsequently, the developer obtained a land develop- <br />ment permit from the Public Works Department to construct all <br />subdivision improvements. <br />The owner/developer, Garden Grove Associates, 'Inc., is now re- <br />questing that final plat approval be granted to the Garden Grove <br />PRD Phase II and has submitted a final plat that substantially <br />conforms to the approved preliminary PRD plat. The Attorney's <br />office has determined that the plat is acceptable in regards to <br />legal form and sufficiency. The Utilities Department has inspect- <br />ed and approved all utilities improvements. The Public Works <br />Department has inspected all road and drainage improvements; <br />however, full contractor's lien releases have not yet been submit- <br />ted. <br />According to the applicant, the contractors cannot fully release <br />the liens prior to final plat approval. In staff's opinion, the <br />Board may grant conditional final plat approval to allow all <br />contractors to file full lien releases. After the releases have <br />been submitted to the County, all County final plat requirements <br />will be satisfied and the Board Chairman could then sign the plat <br />and the plat could be recorded. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners grant <br />final plat approval for the Garden Grove Phase II subdivision <br />subject to the following condition: <br />1. Prior to the Chairman of the Board of County Commissioners <br />executing (signing) the plat, the applicant shall submit full <br />lien releases from all contractors involved in the provision <br />and installation of all required subdivision improvements. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Scurlock, the Board unanimously granted <br />final plat approval for the Garden Grove Phase II <br />Subdivision subject to the condition set out in the <br />above staff recommendation. <br />6 <br />
