PHASE III EXTENSION <br />Public Works Director Davis reviewed the following: <br />TO: James E. Chandler, <br />County Administrator <br />FROM: James W. Davis, P.E., <br />Public Works Director <br />SUBJECT: Status of Permitting and Florida DOT Funding - Indian <br />River Boulevard Phase III Extension to <br />Barber Avenue (37th St) <br />DATE: April 20, 1989 <br />This date, I received a telephone call from Terry Klitzkie, US <br />Army Corps of Engineers Permitting Section, in regards to the <br />subject project. Terry advised me that his supervisor has <br />determined that a permit cannot be issued to the County for <br />construction of the subject project until right-of-way <br />acquisition is complete. 'It appears that the Florida DER could <br />also be forced into an Administrative Hearing by the right-of-way <br />property owner, Mr. Hoffman, if continued objections by Mr. <br />Hoffman remain. If this occurs, the Corps would put the project <br />on a "deactivated" status until resolved or for a one year <br />maximum period. If not resolved in one year, the application <br />would be denied. <br />44 <br />
