During my meetings with Mr. Kirrie he indicated that he could not give or <br />document one specific number of offsite employees. He advised that was <br />because due to the nature of his business the number varied during the <br />course of the year. In an effort to equitably resolve the matter from Mr. <br />Kirrie's standpoint and consistent with what in my opinion appeared to be the <br />Commission's intent, I indicated that I would approve a total of nine (9) <br />employees. This was predicated on family members and the number of off-site <br />employees his type facility would normally accommodate. Considering the total <br />circumstances surrounding this particular site plan, I felt a total number must <br />be established. My decision was related to Mr. Kirrie at our February 28, <br />1989 meeting and in response to his request confirmed by letter dated March <br />30, 1989. <br />Although not related to the employee issue, due to the timing, two additional <br />questions may need to be addressed and resolved. At the time of my <br />meetings with Mr. Kirrie he had applied for a building permit and was subject <br />to 1988 traffic impact fee rates. That time element has since lapsed and the <br />1989 rates are applicable. Additionally, since the site plan was approved on <br />May 17, 1988, the approval normally would expire May 17, 1989, unless <br />extended by the Commission. <br />Administrator Chandler noted that there are 3 issues to be <br />considered this morning: <br />1) Total number of employees allowed <br />2) Traffic impact fee rates <br />3) Extension of site plan for expansion that was approved <br />5/17/88 <br />Commissioner Scurlock asked how many employees had been <br />requested, and Administrator Chandler explained that he was <br />unable to get a specific number from Mr. Kirrie because Mr. <br />Kirrie indicated that he was not able to demonstrate what the <br />numbers were at any given time due to the nature of his business. <br />At one point, Mr. Kirrie threw out the figure of 20, but later on <br />they discussed 12-15 employees. <br />Commissioner Scurlock asked if we had verified the maximum <br />number of employees at any one time and whether staff had checked <br />directly with FICA records, and Administrator Chandler emphasized <br />that we have never received any documentation on the number of <br />employees. <br />Chairman Wheeler asked if Ordinance 87-22 specifically <br />points out the number of employees allowed, and Administrator <br />Chandler stated that Ordinance 87-22 does not specify the number <br />of employees, but does state that employees would be on-site <br />family members.
