Commissioner Eggert wanted to try a Motion at this point <br />because she was tempted to accept Mr. Kirrie's word that the <br />number of employees that he had to grandfather was 8 plus 4. <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Bowman, that the Board allow Mr. Kirrie <br />to have 12 employees; allow Mr. Kirrie to pay the 1988 <br />traffic impact fees; and grant a one-year extension to <br />Mr. Kirrie's site plan for expansion of his business. <br />Under discussion, Frank DeJoia wished to make a few <br />comments. First of all, he felt the County Commission had bent <br />over backwards in allowing this tremendous physical expansion in <br />a home occupation in the ROSE -4 district. They had understood <br />that the expansion was for warehouses and that type of thing, but <br />now, the Commission is talking about more than family members. <br />He felt it was unconscionable of the Commission to allow more <br />than just family employees. Mr. DeJoia emphasized that we are <br />talking about making an exception for an industrial use in a <br />residential area. He didn't believe that even the CH (Heavy <br />Commercial) zoning would allow this type of operation without <br />administrative permits or special exceptions, and was surprised <br />that staff would come up and entertain increased numbers over the <br />family members. That really bugged him and a lot of other people <br />in Roseland. <br />Commissioner Eggert appreciated his feelings, but felt the <br />problem that all of the Commissioners have on this is that back <br />in 1987 we,:grandfathered in the number of non -family employees <br />that were there, and we are still functioning with that. <br />Mr. DeJoia wanted to hear from the County Attorney on that, <br />but Commissioner Scurlock interjected that Mr. Kirrie has given <br />us the Minutes of that meeting and that he accepts that they are <br />correct.
