JUN 6 1989 <br />BOOK 76 mil 986 <br />Commissioner Scurlock asked if the Board has the ability to <br />split the fine between the property owner and the landclearer, <br />and County Attorney Charles Vitunac advised that the Board has <br />that prerogative. <br />Commissioner Scurlock felt that whatever the fine is, they <br />are both equally responsible because they both had a part to play <br />in it. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, that the Board assess a fine of <br />$2500 to be split between the two parties. <br />Under discussion, Chairman Wheeler said he could not support <br />a $2500 fine in this case since there wasn't. any intent, but <br />could support a $500 fine. <br />Commissioner Bowman didn't feel that $500 was enough, and <br />pointed out that slash pines are almost extinct in Dade County. <br />Commissioner Bird felt that a fine of $1,000 split between <br />the two parties would be a good compromise, along with the <br />replanting of 4 slash pines. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The Motion <br />failed by a vote of 2-3, Commissioners Wheeler, Eggert <br />and Bird voting in opposition. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Eggert, by a 4-1 vote, <br />Commissioner Scurlock dissenting, the Board set a <br />fine of $1,000 to be split equally between the owner <br />and the landclearer, and required the replanting of 4 <br />slash pines of 12 feet in height in the area where they <br />were removed with the stipulation that the trees must <br />survive for one year or be replanted again. <br />40 <br />
