cancellation and the acceptance of a certificate of insurance <br />rather than receiving an actual policy. The language in our <br />original agreement stated that "the company will notify us if the <br />insurance is cancelled". The national insurer for the Archery <br />Club uses the language "will endeavor to notify". That means it <br />may be possible that they may not notify us, which is why we are <br />looking at additional language in the contract that should the <br />national insurer not notify us, the onus is then back on the <br />local Archery Club to notify us if, in fact, their insurance is <br />cancelled. The Administrator advised that Gallagher -Bassett has <br />indicated that "will endeavor" is not an uncommon language. The <br />other question Attorney Brennan had was on "certificate" versus <br />"policy". The national insurer for the Archery Club provides a <br />certificate rather than the policy itself, and Gallagher -Bassett <br />didn't have a problem with that either. The new language that <br />will be added in the agreement is that if the policy were <br />cancelled, the Archery Club will notify us. We still will have <br />the language that the insurance company "will endeavor" to notify <br />us, and if they don't, it is incumbent on the Archery Club to do <br />so. We have discussed that with them and they have concurred. <br />Commissioner Bowman didn't like that. She understood then <br />that we are going to accept a certificate instead of a policy. <br />Assistant County Attorney Bill Collins advised that our <br />policy has been to return contractors' insurance certificates and <br />have them x out "shall endeavor to notify" and make it "shall <br />notify", but Administrator Chandler explained that the national <br />insurer has a standardized policy form and does not want to make <br />that change. <br />Commissioner Bowman asked the status of the Risk Manager/ <br />Safety Manager, and Administrator Chandler reported that we are <br />in the process of interviewing applicants. <br />Commissioner Bowman wished to see this item deferred until <br />we have a risk manager on board, but Administrator Chandler <br />IJUW 1999 <br />57 <br />BOOK <br />
