KehtiiTg, AigT <br />Community Devel pmen Director <br />i <br />FROM: Stan Boling, AICP <br />Chief, Current Development <br />DATE: June 5, 1989 <br />SUBJECT: PROPOSED AMENDMENT TO ZONING CODE ESTABLISHING NEW <br />SPECIFIC USE TYPE: AUTOMOTIVE FLUIDS PRODUCTS SALES AND <br />SERVICE OTHER THAN GASOLINE <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of June 13, 1989. <br />DESCRIPTION AND CONDITIONS: <br />The County's existing zoning code does not have a land use <br />�" listing that specifically addresses "quick oil change" type <br />establishments. Presently, the code addresses automotive -related <br />uses under two separate classification headings: "Repair Ser- <br />vices, Heavy" and "Vehicular Sales, Service and Storage". The <br />existing listing most similar to quick oil change type uses is <br />"Gasoline service stations, fuel sales" which appears under the <br />"Vehicular Sales, Service and Storage" classification heading. <br />To date, no one has. disagreed with staff's determination that a <br />gasoline service station is the code -listed use most similar to a <br />quick oil change. facility. However, a developer has disagreed <br />with the appropriateness of the .gasoline service station specific <br />land use regulation criteria found in section 25.1 of the code as <br />applied to a quick oil change facility. Therefore, on. behalf of <br />Karl Hedin, Attorney Michael O'Haire has applied for a zoning text <br />amendment to establish a specific use classification listing to <br />cover quick oil change facilities and to establish criteria <br />appropriate in regulating such activities. <br />At its regular meeting of May 11, 1989, the Planning and Zoning <br />Commission voted to recommend that the Board of County Commission- <br />ers adopt the ordinance proposed by staff with one exception: <br />the Commission recommends that the staff proposed requirement <br />for a 100' separation distance between quick change project <br />sites and residential districts be deleted. <br />ANALYSIS: <br />Existing Code <br />The two classification headings and specific listings applicable <br />to automotive -related activities are as follows: . <br />USE ALLOWABLE DISTRICTS <br />LISTING CN CL CG CH IL IG <br />*Repair Services, Heavy <br />1.)
