He has not heard <br />anything from Schopke contesting that. <br />Yesterday morning the workman from ECSI, who is now sitting <br />in the back of the Chambers, showed up at the Jail ready to <br />continue the warranty work. and he was refused admission to the <br />Jail under our orders. Attorney Vitunac informed the Board that <br />he since has had a series of phone calls from attorneys all over <br />the country begging that we let ECSI come in and finish the job, <br />agreeing that he has been dilatory and not done a good job but <br />saying that he has finally got it all fixed and has the panels in <br />his hand and is ready to put them in, if we would only let him. <br />And also saying that if we don't let him, they will fight us tooth <br />and nail in court and it will be a long, drawn out battle, which <br />Attorney Vitunac agreed it probably would be. He continued that <br />he told them all they were welcome to come to the Board meeting <br />today and see what they could convince the Board of. He believed <br />that staff's position is unchanged. For months ECSI has not done <br />what they promised and so this latest promise has no credibility <br />with us. However, he did believe they have a right to make their <br />statement to the Board and then it is up to the Board whether to <br />continue with staff's recommendation, which is to hire a third <br />party to fix the problem and then we will pursue our legal <br />remedies in court against the bonding company and Schopke or let <br />ECSI go in and try to fix it again. If it is not fixed, then we <br />are in the same position and can hire a third party, etc. If it <br />is fixed, then our problems are over. <br />Attorney Vitunac further advised we asked our consultant, <br />Frizzell, to be here today with all their facts and figures in <br />case we have questions about any of this. <br />Commissioner Bird.commented that he was in Attorney Vitunac's <br />office when some attorney was on the phone in this regard, and he <br />believed that attorney was trying to convince the County that it <br />would be in everyone's interest to give the company an opportunity <br />N 13 1989 67 Boa 77 F,%L 67 <br />
