as to doors being open and doors being closed and secured that <br />actually are not. <br />Mr. Ferry commented that all the feedback they have got is <br />that the panels don't work and he suggested that since he is here <br />that he be permitted to inspect the facility to determine exactly <br />what is wrong before any decisions are made as to the merit of <br />their equipment. <br />Commissioner Scurlock asked how that would affect our legal <br />position, and Attorney Vitunac advised that our choice is to go by <br />the contract and insist that ECSI fix the problem or kick him off <br />and hire somebody else and try to charge the cost back pursuant to <br />the contract methods. We can't have them both working <br />simultaneously. <br />Commissioner Scurlock noted there is nobody working on this <br />yet and asked what another 2-3 weeks would do. <br />Attorney Vitunac stated it would just waste that time if it <br />doesn't solve the problem. We could notify him now that if this <br />is not solved after a month, we would take up the same position as <br />today, and he could waive any notice provisions. <br />Commissioner Scurlock felt that if we let him make another <br />try and he can't fix it, that might make our position even <br />stronger, and Commissioner Bird and Attorney Vitunac concurred <br />that it would. <br />Commissioner Bird further pointed out that if we don't let <br />him try, and we have to have a whole new system designed, we could <br />pay $400,000 for a new system that may not work any better than <br />what we have. <br />MOTION WAS MADE by Commissioner Scurlock that we allow <br />this firm (ECSI) back on the job for a period not to <br />exceed three weeks conditioned on them waiving any <br />future rights. <br />l 6, 8 71 BOOK i <br />UN i 71 <br />
