OW �r'�? <br />EOOR 77 <br />NORTH JUNGLE TRAIL MAINTENANCE MAP <br />Assistant County Attorney Collins reviewed the following <br />with attached newspaper clipping from July 1978 which references <br />workmen clearing R/W for the "county road" northward from the <br />Wabasso Bridge: <br />TO: The Board of County Commissioners <br />FROM: W4.- William G. Collins 11 - Assistant County Attorney <br />DATE: June 20, 1989 <br />SUBJECT: North Jungle Trail Maintenance Map <br />At the direction of the Board, the County Surveyor has <br />prepared a survey of Jungle Trail from C.R. 510 to A1A, the <br />portion of Jungle Trail commonly referred to as "North <br />Jungle Trail". The survey depicts a baseline with <br />measurements to either side of the maintained trail at <br />100 -foot intervals. The maintained right-of-way varies <br />generally between 16 and 21 feet, although it narrows below <br />that 16 -foot dimension occasionally (see Stations 348-350 on <br />Sheet 9 where the road narrows to 14/15 feet), and at one <br />point the road is only 10 feet wide (see Station 303 on <br />Sheet 7). The filing of a maintenance map duly certified by <br />the Chairman and the Clerk of the Board of County <br />Commissioners reciting on it that the road has vested in the <br />County by virtue of its construction by a County and the <br />fact It has been maintained or repaired continuously and <br />uninterruptedly for four years by the County constitutes <br />prima facie evidence of ownership of the land by the County, <br />and the road Is deemed dedicated to the public to the extent <br />and width that has been actually maintained for four years. <br />In the event the County subsequently determines to realign <br />and/or close a portion of Jungle Trail pursuant to the <br />criteria set out in the Jungle Trail Management Plan, such <br />closing of Jungle Trail should be legally described by <br />reference to this baseline survey of the maintenance map. <br />That is, the applicant for closure or realignment of the <br />trail should utilize the baseline survey to determine at <br />what station the realignment departs :.from the existing <br />alignment, and at what station it returns, plus or minus the <br />exact number of feet from any station. <br />RECOMMENDATION <br />That the Board authorize the Chairman, by his signature or <br />the maintenance map, to certify that the road shown thereon, <br />North Jungle Trail, was constructed by the County and has <br />been maintained or repaired continuously and uninterruptedly <br />for four years by the County, and that the road shall be <br />deemed dedicated to the public to the extent and width that <br />has been actually maintained for four years, and that the <br />road has vested in the County by means of intenance <br />map provisions of Florida Statute 95.361(1):nd=RivtrCM Approved <br />Admin. <br />Legal W6,C 6_ <br />Bud9el _ <br />D, o I. p,� 6, <br />18 Risk mgr. _ <br />Date <br />
