special exception criteria. Yet, the Planning staff feels <br />this application is in keeping with the intent of the special <br />exception criteria. <br />The specific criterion in question is #3. Planning staff <br />feels that the intent of this criterion is to separate and <br />buffer the used car dealership from uses on adjacent property <br />and road right-of-way, but not as a setback from the railroad <br />right-of-way Yet, the railroad right-of-way line is A <br />property line, and the criterion reads "any property line". <br />The applicant is seeking approval of the plan with the <br />current design and will follow-up with an amendment to the <br />zoning text, which will permit the used car sales facility as <br />currently designed. The applicant is designating the used <br />car dealership as a separate phase, which will allow for <br />construction of the professional office building while the <br />ordinance amendment is being reviewed and considered. <br />RECOMMENDATION: <br />Based on the analysis performed, staff recommends the Board of <br />County Commissioners approve the used car sales special exception <br />use with the following condition: <br />1. That the special exception use approval for the used car <br />sales portion of the project be contingent upon the special <br />exception criteria being amended by the Board of County <br />Commissioners, to allow the present design. <br />Commissioner Bowman asked about the setback from the FEC <br />property, and Planner Boling stated that it is zero setback. <br />Commissioner Bowman was surprised that they are talking <br />about eventually putting a motel so close to the railroad tracks. <br />The Chairman asked if anyone wished to be heard. <br />Dean Luethie of Carter Associates came before the Board <br />representing the owner, John Tanase. He noted that the P&Z <br />Commission has recommended approval of the proposed ordinance <br />amendment.
