Architect Dean believed it would be fair to add that the <br />developer can research and try to prove the county doesn't own <br />the 50'. There is a joint responsibility here. <br />Technical discussion ensued regarding the complexities of a <br />title search, and Attorney Collins pointed out that even if a 50' <br />R/W was established at one time, there may be some claims that we <br />have lost some of that by reason of adverse possession. <br />Attorney William Caldwell came before the Board representing <br />the applicant, Orchid Island Associates. He informed the Board <br />that he represented the applicant when they closed on the prop- <br />erty involved, and he can state that there is no evidence on the <br />public records in this county, including public records as they <br />existed in St. Lucie County, that reflects any ownership of any <br />of this property by any public body. The title insurance that <br />has been issued on this property, however, reflects the potential <br />of a right of the County in Jungle Trail along its existing <br />traveled way.
