They would ask that the County not restrict buildings being <br />placed on the previous alignment of Jungle Trail, which would <br />affect the one building lot. <br />The Board recessed at Noon for five minutes and then <br />reconvened with the same members present. <br />Attorney Kevin Doty came before the Board representing the <br />County Historical Society. He contended that the abandonment and <br />realignment are separate and distinct items and that there should <br />be no talk of abandonment at this time; advised that they intend <br />to offer evidence that will suggest that any realignment will <br />adversely affect the historical integrity of the Trail; contended <br />that the procedure followed to date is wrong because they feel a <br />Comprehensive Plan amendment is a required step; and advised that <br />there is some evidence this may be a state highway and the County <br />may not have the right to abandon it. Attorney Doty stressed <br />that the Society's ultimate position is that they are opposed and <br />feel this application should be denied and stated that he would <br />at this time renew their request that this item be tabled until <br />the questions he has brought up can be answered. <br />THERE WAS NO MOTION TO TABLE. <br />Attorney Doty began his presentation contending that the <br />applicant's stated reason for the application "to provide <br />necessary security for development and to buffer the Trail from <br />development" is not criteria on which a realignment request can <br />be based.
