There are all types of security <br />gates, but he felt if you want to break into this place, you <br />probably are not going to ride down the main road to do it. Mr. <br />Dean pointed out that Grand Harbor has designed around a road <br />that isn't even there. To wrap up, Mr. Dean felt the Board <br />should either deny this request or table it, and if they were to <br />pass it - absolutely no abandonment. <br />Commissioner Bird believed that Mr. Dean obviously has done <br />a lot of work on his study, and he is also very intelligent and <br />asked that he reason along with him on this. We all want to be <br />able to preserve Jungle Trail and have it for future residents to <br />be able to enjoy; however, this is a very complex matter. If you <br />asked someone if he were opposed to closing Jungle Trail to <br />satisfy one developer, Commissioner Dean believed you could get a <br />thousand signatures in one Saturday morning. The problem is that <br />he believed the most we can be assured of is preserving our <br />ability to preserve 18-20' of Jungle Trail, and there is a <br />question as to whether the Town of Orchid will abide by our <br />setbacks, etc.. As to the 50' R/W, our staff has indicated it is <br />questionable under the law whether we can claim that 50. <br />Commissioner Bird continued that he, therefore, is trying to <br />weigh whether it is a viable tradeoff to take the 70' that has <br />been offered over 3 miles and balance that against the risk of <br />finding out we can control only 18-20' and then have people able <br />to built right up to the edge of the Trail. If the Commission <br />turns the applicant down today and limits ourselves to 18-20' and <br />they end up being able to build right up to the edge of the road, <br />people in the future will look at the Board as idiots. The <br />trade-off is to accept the offer and have a nice buffer. This is <br />not totally a one-sided question. Everyone refers to Jungle <br />Trail as being historic and scenic, but Commissioner Bird be- <br />lieved there is a question of trading off some historic for some <br />scenic values. <br />86 <br />
