Attorney Collins interjected that some questions were raised <br />about 6 hours ago that staff was supposed to respond to, and he <br />believed most have been answered adequately since then, but just <br />for the record, he would like to answer the question that was <br />posed as to whether any realignment would require a Comprehensive <br />Plan amendment. Re cited FS 163.3194, subsection 3(a), and <br />advised that the opinion we have is that if the Board makes <br />findings that the criteria for realignment are met, then our <br />objectives are consistent with our Plan. It would only be if the <br />Board found the criteria for realignment are not met, that we <br />could not make such a realignment without amending the Comprehen- <br />sive Plan. He just wished to get that on the record. <br />Commissioner Bird referred back to the question Mr. McQueen <br />had regarding the 30' habitable setback and asked to have that <br />clarified. <br />Mr. McQueen explained that staff had asked that they set up <br />a 20' buffer and the 30' building setback as a total buffer area, <br />or 501, which is 20' more than the county ordinances presently <br />ask for. They did agree to the additional 10' into the building <br />setback before you could build a fence, and that is as strict as <br />the county's ordinance now. Where they are asking to build a <br />fence, in the county you could build a building, and they are <br />saying they would go 20' before they would have that residential <br />building. He asked that the Board keep in mind that this only <br />occurs in 15 lots throughout the whole development. <br />Commissioner Bird wished further clarification about the <br />500' they are talking about along A -1-A at their entranceway. <br />Mr. McQueen believed Mr. Doty was of the opinion that they <br />wanted to eliminate a 500' strip of Jungle Trail, and that was <br />not so. What staff had asked is that outside this 30' setback, <br />they dedicate all the R/W between that and A -1-A as a conserva- <br />tion easement to protect the vegetation in there.
