Thus, without modification, <br />the, code will have to be applied in an "unbalanced" manner. <br />It is staff's opinion that unenclosed commercial amusements have <br />certain characteristics that warrant special regulation. Specif- <br />ically: hours of operation, and light and noise effects on sur- <br />rounding neighborhoods and roadways are among staff's concerns in <br />regard to location and development of such uses. In staff's <br />opinion, more specific regulations should be included in the <br />zoning code to address adverse effects of outdoor amusements that <br />can potentially generate light, noise, and aesthetic nuisances. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners direct <br />staff to initiate and draft a zoning code text amendment that more <br />specifically addresses and regulates unenclosed commercial amuse- <br />ments. <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Scurlock, that the Board direct staff to <br />initiate and draft a zoning code text amendment that <br />more specifically addresses and regulates unenclosed - <br />commercial amusements. <br />Under discussion, Commissioner Bird wanted staff to take <br />another look sometime in the future at where we are allowing or <br />not allowing some of these outdoor recreational type uses, <br />because he felt that in some cases we are being too restrictive <br />on where they are allowed. <br />Robert Keating, Director of Planning & Development, advised <br />that staff is looking at allowing them in more zoning districts <br />as special exceptions. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The Motion <br />was voted on and carried unanimously. <br />37 <br />
