►-AUL 1 8 Boor <br />INTERGOVERNMENTAL AGREEMENT <br />AN INTERGOVERNMENTAL AGREEMENT made this day of <br />1989, between INDIAN RIVER COUNTY, a political <br />s bdivision of the State of Florida, having its principal office <br />at 1840 25th Street, Vero Beach, Florida 32960, hereinafter <br />referred to as the COUNTY, and INDIAN RIVER FARMS WATER CONTROL <br />DISTRICT, a drainage district operating under the authority of <br />Chapter 298, Florida Statutes, having its principal office at <br />4400 20th Street, Vero Beach, Florida 32960, hereinafter referred <br />to as the DISTRICT. <br />In consideration of the mutual covenants contained <br />herein the parties agree as follows: <br />1. PROPERTY: The DISTRICT owns a three hundred foot wide <br />- 7 <br />Main Relief Canal Right-of-way which traverses Indian <br />River County in a southwest -northeasterly direction <br />between Kings Highway (AKA 58th Avenue) and Lateral "A" <br />Road (AKA 66th Avenue) south of SR60, and <br />On July 14, 1977, the DISTRICT granted permission for <br />the COUNTY to use the north twelve feet of the <br />aforementioned Main Relief Canal right-of-way for the <br />construction of a public road known as Lundberg <br />Road(copy of DISTRICT minutes dated July 14, 1977 <br />attached as Exhibit "A"). In late 1980, the COUNTY <br />proceeded to pave a twenty foot wide road within the <br />north fifty feet of the Main Relief Canal right-of-way <br />to provide a paved roadway from Kings Highway to the <br />Indian River Community College. The location of which <br />paved road is not the agreed upon location as permitted <br />on July 14, 1977 by the DISTRICT. <br />2. PURPOSE: In May, 1989, the Indian River Community <br />College desires to extend the paved section of Lundberg <br />Road westerly for a distance of approximately two <br />hundred sixty feet. Since. this extension would <br />exacerbate the misalignment of the paved road within <br />DISTRICT right-of-way, the DISTRICT has requested that <br />an AGREEMENT between the COUNTY and the DISTRICT be <br />executed to formally establish the COUNTY'S intent to <br />relocate Lundberg Road within the permitted alignment. <br />The purpose of this AGREEMENT is to establish the <br />COUNTY'S responsibility to relocate the paved section <br />of Lundberg Road west of Kings Highway (58th Avenue) in <br />K3: <br />
