All vehicular display areas and off-street parking <br />areas shall have paved surfaces which meet the <br />standards of Section 24 (f) (1) or (2). For the <br />purpose of this ordinance, vehicular display areas <br />shall be paved areas where vehicles for sale are on <br />display. Off-street parking areas shall be paved <br />areas maintained for customer and employee parking._ <br />EXISTING: 3. No vehicular sales area or structure shall be <br />located closer than twenty-five (25) feet to any <br />property line. <br />PROPOSED: 3. No vehicular sales office (building) shall be <br />located closer than twenty-five (25) feet to any <br />property line except any property line that is <br />abutting a railroad right-of-way in which case the <br />structure shall not be located closer than ten (10) <br />feet. Also, no vehicular display areas shall be <br />located closer than ten (10) feet to any property <br />EXISTING: 4. Drives and maneuvering areas <br />shall be designed to permit convenient on-site <br />maneuvering of the vehicles. <br />*(Paved areas where vehicles are displayed.) <br />The major substantive changes occur in the proposed #3 criterion. <br />The intent of the existing #3 criterion was to buffer the used car <br />dealership from uses on adjacent properties and road <br />rights-of-way, but not as a setback from the :..railroad <br />right-of-way. The staff feels there would be no problem with <br />allowing a car sales office to be constructed within 10' of the <br />railroad right-of-way. In the CH (Heavy Commercial) and IL (Light <br />Industrial) districts there is no setback along the FEC railroad <br />right-of-way. <br />The other substantive change would allow vehicular display areas <br />to come within 10' of any property line. It could be interpreted <br />from the existing criterion that no paving could be located within <br />25' of any property line. The proposed change is less restrictive <br />than the "blanket" existing 25' setback criterion but is also <br />slightly more restrictive than the criteria for standard commer- <br />cial or residential parking lot designs. All parking lots are <br />required to have a 10 foot landscape strip between a right-of-way <br />and the parking lot, and a 4' landscape strip between a parking <br />lot and an adjoining property line. This revised criterion would <br />create a 10' landscape strip for display areas abutting a property <br />line. The staff feels the 10' setback from any property line to a <br />display area is an adequate separation distance. <br />16 <br />- W M <br />
