Director Keating suggested that the Board make it part of <br />the Motion to authorize staff to discuss with the applicant the <br />possibility of a purchase. <br />Chairman Wheeler opened the Public Hearing, and asked if <br />anyone wished to be heard in this matter. <br />Jeannette Lier, One Michael Creek Drive, asked that if the <br />Board decides to have parking on the west side of the Trail, to <br />have it as shell not asphalt. <br />Director Keating advised that very tight constraints on <br />run-off going into the river would settle that issue. <br />There being no others who wished to be heard, the Chairman <br />closed the Public Hearing. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, that the Board approve staff's <br />recommendation with the conditions set out in the <br />above memo. <br />Under discussion, Commissioner Bird said that he would vote <br />for this, but would request that we talk to the developer about <br />providing some space for public access there. <br />Mr. Boling reported that the developer seems amenable to <br />providing some public spaces there. <br />Commissioner Bowman asked where this leaves Attorney <br />O'Haire's client, Mr. Preuss. Are we saying there must be a <br />buffer between his property and this project? <br />Mr. Boling advised that would be something that would be <br />looked at when they came back with their site plan. <br />Commissioner Bird stated that, in all fairness to Mr. <br />Preuss, he didn't know what more we could do to create any more <br />of a passive situation on that property than what we are <br />proposing other than leaving it vacant. <br />Attorney O'Haire noted that his client is just not <br />comfortable with a <br />"trust me" position <br />on the part of <br />the <br />J9 UL <br />b -1989 <br />31 <br />
