Keating, AICP <br />Community -Development Director <br />THROUGH: Stan Boli$ AICP <br />Chief, Current Development <br />FROM: Stan Boling, AICP <br />Chief, Current Development <br />DATE: July 21, 1989 <br />SUBJECT: GRAND HARBOR BEACH CLUB MEMBERSHIP RESTRICTIONS <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of July 25, 1989. <br />BACKGROUND: <br />On December 8, 1987, the Board of County Commissioners granted <br />conditional special exception approval for the Grand Harbor Beach <br />Club facility with one of the conditions involving the <br />establishment of recorded covenants restricting membership and use <br />of the club facilities (see attachment #2). Said covenants are to <br />be approved and recorded prior to issuance of a Certificate of <br />Occupancy for the project. The project is now essentially <br />complete. <br />The developer has submitted covenant and restriction documents in <br />order to meet the condition placed upon the project approval. <br />Planning and Attorney's Office staff have reviewed the proposed <br />restrictions (see attachment #3) and have not approved what is <br />being proposed. The proposed covenants and restrictions do not <br />comply with the stated intentions of the initial beach club <br />developer. It appears to staff that the Board's decision to <br />approve the project conditionally may have been based upon state- <br />ments made by the initial developer which are not incorporated <br />into the restrictions now proposed by the current project develop - <br />8 <br />
