r -I <br />I <br />`� 7 54� <br />@ Ft:i�C <br />swap off and trade the position of the utilities within the <br />drainage easements without having to come back before the County <br />Commission. <br />Attorney Collins explained that whether or not it will come <br />back to the County Commission depends on the nature of the <br />development and whether it is something that requires a public <br />hearing. If it is something that can be handled administratively, <br />but involves a release of easement, it can be brought to the Board <br />on the Consent Agenda. <br />Commissioner Scurlock believed the real effort here is to <br />retain the County's utility rights in case the project doesn't go <br />ahead in an overall concept. <br />Mr. Boling felt that Mr. Fountain's concern was time delays <br />and that he didn't want to be slowed down in the process and have <br />to come before the Board again. <br />Attorney Collins noted that the procedure for a release of <br />easement is a lot easier than a road abandonment. <br />Mr. Boling advised that it takes 4-6 weeks for a release of <br />easement, but site plan approval takes that long also. They could <br />track both requests through concurrently. <br />Mr. Fountain understood that there would not be any rezoning <br />necessary, and Chairman Wheeler explained that Mr. Fountain could <br />come in and do his site plan and take care of all the drainage, <br />and after the site plan is approved at the Planning & Zoning <br />Commission meeting, the release of easement probably would come <br />before the Board the following week. Chairman Wheeler emphasized <br />that we are not talking about an additional 6-8 weeks; we are <br />talking about tracking the two requests concurrently. <br />18 <br />
