Wiegers <br />Staff Planner <br />DATE: July 28, 1989 <br />SUBJECT: OLD SUGAR MILL ESTATES UNIT 5 & 6 SUBDIVISION <br />MAINTENANCE AGREEMENT SECURITY AND CONTRACT FOR <br />CONSTRUCTION <br />It is requested.that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of August 8, 1989. <br />DESCRIPTION AND CONDITIONS: <br />On January 24, 1989, the Board granted final plat approval to the <br />.Old Sugar Mill Estates Unit 5 & 6 subdivision, an 8 lot subdivi- <br />..sion located on the north side of 12th Street, adjacent to the <br />::previously platted Old Sugar Mill'` Estates Subdivision. At the <br />time of final plat approval, the owner's agent, Mr. Jim Beindorf, <br />;contracted with the County to finish construction of the required <br />subdivision imparovements and posted an irrevocable letter of <br />.credit in the .amount of $40,000 to secure the construction <br />'contract. <br />The applicant is now requesting that the Board release the $40,000 <br />letter of credit and accept the required warranty maintenance <br />%agreement with the necessary maintenance bond. <br />ANALYSIS: <br />The Public Works department has inspected the subdivision and has <br />verified that all required improvements have been constructed and <br />are acceptable. Public Works has indicated that' the original <br />construction contract and letter of credit may now be released. <br />The project engineer has certified that 25% of the actual cost of <br />the total required subdivision improvements is $10,000. <br />The applicant has submitted a warranty maintenance agreement with <br />a maintenance bond in accordance with Section 8 of the subdivision <br />ordinance. The .Board may now accept the warranty maintenance <br />agreement with the maintenance bond and release the existing <br />contract for construction of required improvements. <br />The applicant's submittals have been approved by the County <br />Attorney's office, and satisfy all applicable County requirements. <br />RECOMMENDATION: <br />Staff recommends that <br />the original contract <br />and $40,000 letter of <br />maintenance agreement <br />■ <br />the Board of County Commissioners release <br />for construction of required improvements <br />credit, and accept the submitted warranty <br />and bond. <br />0 <br />
