INDIAN RIVER TRAILS' PROPOSAL FOR DEED EXCHANGE RE JUNGLE TRAIL <br />The Board reviewed memo from Asst. County Attorney Collins: <br />TO: <br />The Board <br />of County <br />Commissioners <br />FROM: <br />William G. <br />Collins <br />If - Assistant County Attorney <br />DATE: August 30, 1989 <br />SUBJECT: Indian Trails' Proposal for Deed Exchange <br />Regarding Jungle Trail <br />The Indian Trails development in the Town of Indian River <br />Shores Is about to file a replat of a portion of their <br />development. Through their attorneys, Collins, Brown 8 <br />Caldwell, they have forwarded proposed deeds which would <br />facilitate moving the Jungle Trail Maintenance Map easterly <br />away from the shore of the Indian River. The developer's <br />concern is that as the shoreline erodes, the trail itself <br />will move or encroach further and further to the east onto <br />the property which they are developing. Thus, they are <br />proposing that prior to platting the next phase of their <br />development, they will deed an additional ten feet to the <br />County in an exchange for the County quit -claiming the west <br />ten feet of Jungle Trail Maintenance Map area to the <br />developer. This may also have the effect of establishing <br />some additional riparian rights for the Indian Trails <br />development. <br />If the exchange is accepted, Indian Trails proposes to issue <br />a deed to the County for a full 40 feet, lying 10 feet to <br />the east of the current maintenance map alignment. <br />The portion of the Jungle Trail Management Plan dealing with <br />alignment contemplated making minor alignment modifications <br />to enhance the safety of the trail on its northern portion. <br />It also states: <br />"There may be proposals to slightly <br />realign the trail in some spots to <br />accommodate a proposed development <br />project for which realignment has been <br />proposed. <br />There appears to be no need to address <br />realignment of the southern portion of <br />the trail. Because of existing adjacent <br />development and the existence of a <br />legally constituted maintenance <br />right-of-way, the roadways alignment Is <br />set. For the northern portion of the <br />trail, however, it may be possible to <br />allow realignment of the roadway in <br />certain areas ..." <br />Thus, the Management Plan took the southern portion of the <br />trail as a given. However, the Management Plan also <br />contemplates the County providing "a mechanism by which a <br />land owner may request realignment of Jungle Trail.
