In this case, <br />however, the developer is requesting an immediate response, <br />and his proposed project requires no approvals from the <br />County. Thus, the normal time for the different interested <br />parties to provide input and make recommendations as to <br />whether or not the criteria for realignment are met cannot <br />be met. The authority to approve the replat of Indian <br />Trails lies exclusively with the Town of Indian River <br />Shores. The developer is simply offering an opportunity to <br />shift the maintenance map ten feet to the east without <br />affecting the actual traveled way of Jungle Trail. Should <br />the County not be able to respond immediately, a plat wi I I <br />be filed running immediately adjacent to the easterly line <br />of the maintenance map as currently filed. <br />The options available to the County are as follows: <br />1. Accept the proposal for exchange of deeds to move the <br />maintenance map alignment ten feet to the east. (The <br />traveled way would not be realigned.) <br />2. Obtain necessary permits to stabilize the existing <br />shoreline in order to prevent future encroachment of <br />the trail onto the Indian Trails' property, and the <br />developer will proceed to plat Indian Trails to the <br />existing east boundary of Jungle Trail. <br />A last minor issue to be considered is the alignment of such <br />a shifted portion of the trail with any portions of the <br />trail to the north and south, I .e., ensure that no jogs in <br />the road which would constitute a safety hazard are created. <br />The consensus of the Public Works Director, Community <br />Development Director and -Assistant County Attorney is the <br />deeded 40 -foot right-of-way would be superior title to a <br />40 -foot maintenance map claim which is valid only to the <br />extent the travelled way is maintained (20-251). <br />RECOMMENDATION <br />1. Inform the developer which of the platting options Is <br />preferred by the County. That is, immediately adjacent <br />to the present maintenance map alignment or ten feet to <br />the east of the existing maintenance map alignment. <br />2.
