r SEP 2 1989 <br />MOK <br />Attorney Vitunac explained that when the the Board ratified <br />the proposed contract several weeks ago, Commissioner Bird <br />suggested an amendment on the access to the wetlands. The <br />amendment is typed in at the bottom of the contract: " At closing <br />Seller shall execute to Buyer an easement across lands adjacent to <br />and North of S. Relief Canal for public access by automobile to <br />Parcels 3 and 4. This easement will state that its use wi4:1 not <br />unreasonably interfere with the operation of Vista Royale Gardens <br />Golf Course in the same manner it is being operated on the date of <br />this Contract." The restriction that we will not interfere with <br />the operation of that particular golf course hole is somewhat of <br />an impediment, but staff feels in real life it won't be something <br />we can't live with. Mr. Ewing is unable to give us any better <br />access simply because of the geography of the situation. <br />Immediately south of that access, we also will have the access <br />from the St. Johns River Water Management District, so i.f push <br />comes to shove, there probably are other ways of getting in there <br />in the future. <br />Administrator Chandler explained that this is the access that <br />was provided to us when the County got the wastewater facilities, <br />and although the language in that seemed to be clear that we could <br />have access beyond the use of the local wastewater facilities, we <br />wanted to make sure that it was absolutely clear. <br />Commissioner Eggert was concerned that the site plan that is <br />being shown by the McKee Jungle Gardens Preservation Society shows <br />2-3 cuts out onto U.S. #1, but Chairman Wheeler didn't think that <br />the DOT would approve any additional cuts. <br />Commissioner Bird asked if we are buying the main entrance <br />road going into Vista Gardens, and Administrator Chandler <br />confirmed that the purchase incorporates that road and also the <br />parcel on the corner of U.S. #1 and Indian River Boulevard. <br />Commissioner Bird was concerned about buying that private <br />entrance road because of the maintenance responsibility. <br />32 <br />
