ANALYSIS: <br />Blevins Electric, Inc. has offered a contract to guarantee their <br />work, r warranty for a year, and the posting of a 100% performance <br />bond. They have quoted a price of $346,273 for a "lock and key" job. <br />The original estimated cost provided by our architect, W.R. Frizzell, <br />was over $400,000 to perform this work. <br />FUNDING: <br />Monies for this project will come from Phase III Construction funds. <br />After the project is complete Indian River County will file with <br />Schopke Construction Company's bonding company (Hartford) to recover <br />our cost. <br />RECOMMENDATIONS• <br />Staff recommends Board approval of the proposed contract with Blevins <br />Electric, Inc., and authorize the Chairman to execute the applicable <br />documents. <br />Commissioner Bird wished to know realistically what our <br />ability is to recapture this additional expense. <br />County Attorney Vitunac believed it is the same as it <br />always was. He understood it is always an effort to get a <br />bonding company to pay up, and we will go to court. We are <br />taking all the necessary steps to do that, and our records are <br />good enough that he feels we should win. <br />Commissioner Bird just wanted to be sure that someone is <br />quarter -backing this in order to build the strongest case we can, <br />and Attorney Vitunac advised that we are keeping a trail; we have <br />a history of past acts by ECSI; and staff is working with <br />Frizzell to track the costs involved. Part of the damages will <br />be the cost of fixing the system. <br />Commissioner Bird believed our claim is against Schopke, as <br />genera:.) contractor, and his bonding company, and that was con- <br />firmed. <br />Commissioner Scurlock hoped that we will document the <br />factual situation very carefully as he envisioned that, to limit <br />their damages, they will come in and say if we had allowed them <br />to continue on, we would have had less cost to make the repairs. <br />Attorney Vitunac noted that we did allow them in and gave <br />31 <br />SEP J P 1989 <br />L <br />I <br />
