OCT 6b9 <br />BOOK 78 FAA.12 <br />I can understand requiring a 60 feet right-of-way on streets that <br />are off a thoroughfare, so there would be a uniformroad and. <br />access. But here the 30 -foot grant does not provide for a 60 <br />feet street along Glendale. It forces a person to give <br />right-of-way free to the County, even though other owners do not <br />have to do so, for future county expansion merely because that <br />person is trying to upgrade his living conditions. Needless to <br />say, he will be damaged if he cannot get the permit now, as his <br />former home is gone. <br />Private property is important to our way of life, so much so, if <br />you sue a person for a million dollars, you get a 6 -person jury. <br />If the state wants to take your life or your property, you get a <br />12 -person jury. There is no relationship to any public need to <br />extort this right-of-way from my son. Incidentally, this is a 10 <br />acre grove, from which he earns his income. <br />Your consideration as promptly as possible would be appreciated, <br />since my son‘ cannot proceed further without the, permit. <br />If <br />necessary, please put this matter on the next agenda, and, in the <br />',interim, I would be glad to meet with Jim Chandler if it would do <br />any good. <br />V - truly yours <br />Attorney Jackson advised that he would explain the problems, <br />and then he would like his son to explain what happened to him. <br />Number one is that at the last minute, his son went up to get his <br />permit which was already issued and heard for the first time that <br />we will give you the permit, but we have to take 30' of your land <br />without just compensation. Fortunately, his son did not sign <br />that document. Attorney Jackson noted that the first problem is <br />giving up the land, and the second is that his son is out there - <br />he has done everything he supposed to except this, and he can't <br />finish building. He has already spent a lot of money out there, <br />and he has destroyed his mobile home removing it. The County <br />Attorney wants him to deed the land and then fight the County in <br />court. Attorney Jackson was agreeable to fighting the County in <br />court but wanted his son to be able to finish moving ahead with <br />his property and get on with his life. <br />21 <br />
