BOOK .78 AGE r <br />AN AGREEMENT BETWEEN <br />INDIAN RIVER COUNTY, FLORIDA <br />and <br />SEALDSWEET GROWERS, INC. <br />GRANTING REIMBURSEMENTS FOR OVERSIZING CERTAIN <br />WATER UTILITIES REQUIRED BY THE COUNTY <br />THIS AGREEMENT, made this 10th day of October , 1989, by and <br />between INDIAN RIVER COUNTY, a political subdivision of the State <br />of Florida, 1840 25th Street, Vero Beach, Florida 32960, (County), <br />and SealdSweet Growers, Inc., 110 East Oak Avenue, Tampa, Florida <br />33602 (Developer), <br />WITNESSETH: <br />WHEREAS, the Developer, in conjunction with the construction of <br />an office building for SealdSweet Growers, Inc., is constructing an <br />off-site water main extension to serve the subject project; and <br />WHEREAS, the County has required the Developer to oversize the <br />off-site water main extension to serve the regional area and has <br />agreed to reimburse the Developer for the cost of oversizing these <br />utilities; <br />NOW THEREFORE, for and in consideration of the premises and <br />other good and valuable consideration, the County and Developer <br />agree as follows: <br />1. The Developer shall construct water main as permitted by <br />the Indian. River County Utilities Department, including oversizing <br />necessary to serve the subject project and surrounding area. The <br />County agrees to reimburse the Developer for the oversizing of <br />utilities as outlined below: <br />A. ITEM <br />TOTAL REIMBURSEMENT <br />Water Distribution System: $19,360,00 <br />2020 feet of 12 inch diameter <br />water main along the south right- <br />of-way of State Road 60 from the <br />existing water main located at the <br />east property line of Tamara Gardens <br />to 40 feet east of proposed pavement for <br />74th Avenue, plus 400 feet of 12 inch <br />diameter water main along the west <br />right-of-way of 74th Avenue south of <br />State Road 60. Reimbursement shall be <br />according to the standard rate of <br />$2/inch of oversizing/foot of line, <br />calculated as follows: <br />4" of oversizing ($2/inch of oversizing) 2420 feet= <br />45 <br />$:19,360.00 <br />
