DESCRIPTION AND CONDITIONS: <br />Mosby and Associates has submitted an application for minor site <br />plan and special exception approval on behalf of Central Assembly <br />of God for a 320' radio tower to be located at 6767 S.R. 60. The <br />subject parcel is zoned A-1 and will require special exception <br />approval to construct a radio tower. <br />The 320' tower will serve as an FM broadcasting facility. The <br />applicant has already secured the required FCC and FAA permits, <br />and is in the process of securing a required Florida Department of <br />Transportation permit or letter of exemption. <br />Special exception uses are those types of uses that would not <br />generally be appropriate throughout a particular zoning district. <br />However, when special exception uses are carefully controlled as <br />to number, area, location, and/or relationship to the vicinity, <br />such uses would not adversely impact the public health, safety, <br />comfort, good order, appearance, convenience, morals and general <br />welfare and as such would be. compatible with permitted uses within <br />the particular zoning district. In granting any special excep- <br />tion, the Board may prescribe appropriate special conditions and <br />safeguards to assure the use is compatible with surrounding uses <br />in the district. <br />At its September 14, 1989 meeting,the Planning and Zoning Commis- <br />sion recommended 4 to 3 that the Board of County Commissioners <br />deny the special exception request.- The Planning and Zoning <br />Commission concluded after much discussion that the proposed <br />tower's location was not appropriate in a developing area with <br />existing and plan -designated residential uses (see attachment #4). <br />At the Planning and Zoning Commission meeting,the issue of Federal <br />Aviation Administration (FAA) permitting irregularities came up. <br />It appears as though the City of Vero Beach airport officials did <br />not receive the standard FAA comment sheet, even though an FAA <br />permit was issued. Since the Planning and Zoning Commission <br />meeting at which the tower request was considered, the City of <br />Vero Beach airport officials have been in contact with the Federal <br />Aviation Administration and have reviewed this tower application. <br />Subsequently, the City of Vero Beach airport officials have issued <br />a letter of no objection to construction of the proposed tower. <br />(see attachment #5). <br />After 'reviewing the subject request, the Planning and Zoning <br />Commission determined that the special exception criterion K (see <br />report item 12K) is not satisfied by the request, and concluded <br />that the tower would have an adverse aesthetic impact on <br />surrounding existing and future residential uses in the subject <br />area. <br />In the staff's analysis, proximity to existing subdivisions was <br />given consideration in relation to safety and appearance. The <br />proposed tower would be well set back from the Central Assembly <br />property boundaries and would not appear to pose a health or <br />safety threat to adjacent properties or residences. Also, staff <br />notes that although towers do not have an aesthetically pleasing <br />appearance, the existing WAXE and WGYL radio towers located in the <br />South County do not appear to have adversely affected area growth <br />and residential development. <br />ANALYSIS: <br />1.
