L.' Late Night Retail Store Ordinance <br />BOOK /9 DGE 19 <br />The Board reviewed the following memo dated 1/31/90: <br />TO: Board of County Commissioners <br />THUR: Charles P. Vitunac - County Attorney <br />FROM: Sharon P. Brennan - Assistant County Attorney 5_� <br />DATE: January 31, 1990 <br />SUBJECT: LATE NIGHT RETAIL STORE ORDINANCE <br />On March 22, 1988, this Board considered adoption of an <br />ordinance which would regulate late night retail store <br />operation. After discussion, the Board decided to table the <br />matter, until there was an opportunity to see how effective <br />similar ordinances were in other cities. <br />The City of Vero Beach adopted such an ordinance in March of <br />1988, and according to Police Ch-ief Jim Gabbard, there have <br />been no robberies or other problems in the subject stores <br />since that time. I have also spoken with City of Sebastian <br />Police Sergeant Hardison, the midnight supervisor, who has <br />stated that to the best of his knowledge, there have been no <br />robberies of late night stores within the City of Sebastian <br />since the adoption of their ordinance in 1986. 1 have <br />attached a newspaper article describing the results In the <br />City of Gainesville since the passage of its ordinance in <br />1986. A draft ordinance based on the City of Vero Beach <br />ordinance is presented today for approval to advertise, <br />should the Board decide to proceed with adoption of this <br />type of ordinance. This ordinance would require late night <br />retail stores to either: <br />1. Have a minimum of two employees on the premises <br />from 11:00 p.m. until closing or 7:00 a.m., which <br />ever occurs first; or <br />2. Construct a self-contained pay booth meeting <br />standards contained in the ordinance for the <br />protection of the cashier(s); or <br />3. Install an audoivisual monitoring system which <br />allows security personnel live access to the <br />operation 24 hours a day. <br />Assistant County Attorney Sharon Brennan explained that this <br />ordinance is an adaptation of the one used by the City of Vero <br />Beach, and at the Chairman's request she called various <br />convenience stores to see how the ordinance had worked out. Some <br />of the store managers suggested that the hours be earlier than <br />11:00 o'clock P.M., and one store even felt that it should be as <br />early as 8:00 o'clock P.M. <br />13 <br />
