DESCRIPTION AND CONDITIONS: <br />At its regular meeting of October 17, 1989, the Board of County <br />Commissioners reviewed and approved an ordinance (ORD. 89-30), <br />which comprehensively addressed unenclosed commercial amusements <br />(eg. drive-ins, miniature golf courses, race traces, driving <br />ranges). During consideration of Ord. 89-30, the Board expressed <br />an opinion that the ordinance was too restrictive in its regu- <br />lation of where driving ranges could be located within the ag- <br />ricultural zoning district (A-1) (See attachment M. While <br />adopting Ord. 89-30 as proposed, the Board also directed staff to <br />revisit the regulation of driving ranges in the agricultural <br />district. Staff has now addressed the Board's expressed concerns <br />and is proposing an amendment to the zoning code to allow, under <br />certain circumstances, driving ranges on agriculturally zoned <br />property that has a residential land use designation. <br />At its regular meeting of January 11, 1990, the Planning and. <br />zoning Commission unanimously recommended that the Board of County <br />Commissioners adopt the proposed ordinance (see attachment #2). <br />ANALYSIS: <br />�.„.Ordinance 89-30 allows driving ranges in the agricultural district <br />only as an administrative permit use and only on sites having a <br />__anon -residential land 'use designation. The Board was of the <br />g=== opinion that limiting driving ranges to either commercial nodes or <br />=.-.-=F.==far-removed agricultural areas was too restrictive. Board members <br />opined that with restrictions such as daytime use only, a driving <br />'-Y==-:T_ range could be a compatible "holding” use in developing, residen- <br />tially designated areas. <br />-Based upon the Board's directive, staff has drafted an ordinance <br />which: <br />1. continues what Ord. 89-30 established, allowing driving <br />ranges in the A-1 district areas which have a non-residential <br />land use designation, by administrative permit approval; and <br />2. "opens up" areas where driving ranges could be developed by <br />allowing driving ranges in A-1 district areas designated for <br />residential use, by special exception approval. <br />The proposed ordinance (see attachment $4) contains two sections <br />of substance.. <br />SECTION l:modifies the A-1 district regulations to allow <br />driving ranges in residential designated land use <br />areas by special exception approval. <br />SECTION 2:applies the appropriate administrative permit <br />criteria to the special exception criteria stan- <br />dards. and establishes additional criteria to <br />special exception applications as follows. <br />a. A 150' building setback from project bound- <br />aries is applied. <br />b. Driving range hours of operation are limited <br />to daylight hours only; lighting of the range <br />area is prohibited. <br />C* Site access is required to be from a Thorough- <br />fare Plan road. <br />d.
