MAR 6 1990 �; � _a r <br />BOOK .i � PAGt � <br />Attorney Vitunac advised that it should be everyone who is <br />receiving a benefit, but the Board can make a decision that some <br />people don't really get enough benefit to be in the district. <br />Commissioner Scurlock understood then that we have enough <br />flexibility, if we so choose, to eliminate those two assessments, <br />and Attorney Vitunac advised that the Board would have to make a <br />finding that they would not receive enough benefit. However, if <br />they are in the district under the MSTU and receiving a benefit, <br />they should pay. After looking at the law and who is in the <br />district, he personally felt they should pay. There is a way we <br />could proceed more expeditiously and that is under Public Works <br />standard procedures for special assessments. <br />Mrs. Roberts expressed their appreciation of Director Davis's <br />patience and help in this matter, but they don't feel they can <br />afford to kill this project or have it hang on the issue of the <br />elimination of St. Edward's School and The Moorings. <br />Attorney Vitunac advised that the Board could have Director <br />Davis bring back a proposed district, and then we would pass the <br />four resolutions saying it is a project we like and here's the <br />proposed roll. Then we would schedule a public hearing for all <br />the people, go out to bid, do the project and collect it like a <br />regular assessment. However, the County would have to advance the <br />funds because we would need to have the money in hand. Under our <br />normal procedure, we front the money, do the project, and then <br />special assess everyone and get the money back. <br />OMB Director Joe Baird advised that right now we do not have <br />$330,000 appropriated for this purpose. In an assessment program, <br />the money goes out in about a year. In other words, there would <br />be an expense in this year that was not appropriated. We would <br />have to do a budget amendment for $330,000 if we want to do it <br />this year. If we wait until October, we would just handle it in <br />the budget sessions in July. <br />18 <br />
