Chandler, County Administrator MM <br />THRU: Jack Price, Personnel Directoro;" <br />FROM: Beth Jordan, Risk Manager.i4i <br />DATE: March 6, 1990 <br />SUBJECT: Request for Board Consideration; Insurance for First <br />Baptist Church/Main Library Parking Lot <br />This is to request Board approval to purchase liability insurance <br />coverage for the parking lot owned by First Baptist Church, Vero <br />Beach, and utilized as a public parking lot for the Main Library <br />which is under construction. <br />Background <br />On April 11, 1989, the Board entered into an agreement with First <br />Baptist Church of Vero Beach, Inc. for joint utilization of the <br />church -owned parking lot adjacent to the new Main Library. The <br />agreement, entered into for an indefinite term, required the County <br />to hold harmless the Church for all liability which occurred as a <br />result of County use of the parking lot; and also required the <br />County to name the Church as an additional insured on the County's <br />liability insurance policy, then carried by Arthur J. Gallagher & <br />Company. <br />Analysis <br />On November 1, 1989, the Board entered into a self-insurance <br />program with the Florida League of Cities, Public Risk Services, <br />which relies upon the sovereign immunity protections afforded to <br />public entities to cap its liability exposure at $100,000 per <br />person, $200,000 per occurrence, unless a claims relief bill is <br />passed by the Florida Legislature. Those protections are available <br />only to public entities. The County, therefore, cannot extend its <br />protections to a private corporation such as the Church. Because <br />the agreement with the Church requires the additional insured <br />provision, and the hold harmless provisions expose the County to <br />greater financial risks than those capped through sovereign <br />immunity, we have explored with the League and the County Attorney <br />our options for coverage. Our recommendation is that we insure the <br />liability associated with the parking lot through a separate <br />47 <br />MAR 131990 <br />FrUC <br />
