RESOLUTION NO. 2013- <br /> A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br /> INDIAN RIVER COUNTY, FLORIDA CONCERNING SPECIAL ACTS OF <br /> LOCAL APPLICATION REGARDING FISHING AND FISHING GEAR, AS <br /> REQUESTED BY THE FLORIDA FISH AND WILDLIFE CONSERVATION <br /> COMMISSION. <br /> WHEREAS, The Florida Fish and Wildlife Conservation Commission (the "Commission") <br /> has requested that the Board of County Commissioners review those special acts of local application <br /> relating to fishing regulations in Indian River County; and <br /> WHEREAS, Chapter 21305 prohibits any person from taking or attempting to take fish with <br /> anything other than hook and line from within the channel of the Indian River; and <br /> WHEREAS, Chapter 77-572 generally prohibits the taking fish with anything other than hook <br /> and line,pole and line, rod and reel or hand thrown cast net; and <br /> WHEREAS, Chapter 79-480 prohibits the harvest of shellfish which is within 75 feet of the <br /> shoreline or privately owned submerged lands or privately owned dock; and <br /> WHEREAS, the Commission has advised that these three special acts of local application are <br /> either duplicative or contrary to the more current state-wide regulations governing fishing and fishing <br /> gear; and <br /> WHEREAS, the Commission attempts to regulate species and gear on a statewide basis in <br /> order to maintain consistency and fairness throughout the State; and <br /> WHEREAS, the Commission has requested that the Board of County Commissioners review <br /> these special acts of local application to determine whether these three special acts of local application <br /> can be repealed. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY that: <br /> 1. Repeal of Special Acts of Local Application ConcerningFishing.
