S. <br />Environmental Control Officer <br />SUBJECT: Report of Activities for <br />Third Quarter 2014 (April 1 -June 30, 2014) <br />The following is a summary of enforcement activities conducted by the Environmental <br />Control Office during the above quarter: <br />1. Respondent Gaddis Capital Corporation has owned real property located at 4410 <br />45th Street, Vero Beach, Florida for the duration of this proceeding. On or about <br />September 9, 2013, Petitioner conducted an inspection of the subject property <br />finding a sanitary nuisance present in that there were multiple piles of auto and truck <br />tires as well as other debris that were observed to be breeding disease carrying <br />mosquitoes. The Respondents were directed to take all measures necessary to <br />remove and abate all mosquito breeding areas upon the subject property including <br />the proper documentation of disposal for potentially regulated debris, such as tires <br />as well as any and all regulated debris discovered. Upon inspection of the premises, <br />Petitioner noted that several conditions existed in violation of Chapter 386.041(1)(e), <br />Florida Statutes, in that a sanitary nuisance was present due to the subject property <br />having existing harborage for breeding of flies, mosquitoes, or other arthropods <br />capable of transmitting diseases, directly or indirectly to humans. <br />The violations described above warrant civil penalties of up to $500.00 per day per <br />violation. The property has been re -inspected by the Petitioner, and the violations <br />do all continue to exist on the Respondent's property. From the time of the <br />December 5, 2013 hearing to the present time, minimal clean-up of tires has <br />occurred on the property with the additional pressure from the Code Enforcement <br />Board, as well as with the assistance of Mr. Joseph Paladin, an independent <br />consultant retained by the property owners, or an agent of the property owners. This <br />case was brought before the December 5, 2013, ECHB and an Order was entered <br />against the Respondent requiring the property to be cleaned up, and ordering <br />payment of a Civil Penalty in the amount of $2,500.00.
