Endangered Species: The environmental survey submitted for the project indicates the <br />limited presence of gopher tortoises on the subject site. Prior to issuance of a land <br />development permit for the first phase or any successive phase, the applicant will need <br />to provide a gopher tortoise relocation permit or clearance letter from the Florida Fish <br />and Wildlife Commission. In addition, the site has been identified as a possible wood <br />stork (wading bird) foraging area. Mitigation for wading bird habitat is being <br />addressed through on-site wetland preservation/enhancement and off-site mitigation, <br />in accordance with required environmental permits. <br />Land Clearing: One of the concerns expressed at the Planning & Zoning Commission <br />public hearing related to the phased clearing of the site. The applicant indicated that <br />the site will be cleared on a phased basis. Consistent with the PZC's recommendation, <br />a condition has been incorporated into staffs recommendation that limits clearing to <br />a phase by phase basis and requires the developer to obtain a separate land clearing and <br />tree removal permit for each phase. <br />9. Concurrency Management: The applicant has obtained a conditional concurrency certificate <br />for 397 units, which satisfies the requirement for rezoning and conceptual PD plan approval. <br />10. Stormwater Management: As with standard single-family subdivisions, a conceptual <br />stormwater management plan is required prior to conceptual PD approval. For this project, a <br />conceptual stormwater management plan has been approved by the Public Works Department. <br />The stormwater system will consist of a series of interconnected lakes that collect, hold, and <br />treat stormwater and then discharges the treated stormwater into the Indian River Farms canal <br />located on the south side of 37th Street. A preliminary stormwater management plan will be <br />reviewed and approved by Public Works with the preliminary PD. Review and approval of the <br />final stormwater management plan will be accomplished through the land development permit <br />review and approval process. <br />11. Thoroughfare Plan: The project has frontage on three Thoroughfare plan roads. These are: <br />33rd Street, 37th Street, and 58th Avenue. <br />• 58th Avenue is classified as an urban arterial requiring 130' of ultimate right-of-way. <br />Presently, 25' of right-of-way west of the section line (approximate roadway <br />centerline) exists for 58th Avenue adjacent to the project site. The applicant proposes <br />to dedicate without compensation an additional 40' to create 65' of right-of-way west <br />of the section line, which is the applicant's portion of the 130' of ultimate <br />right-of-way. The 40' of additional right-of-way is shown on the project's conceptual <br />PD plan and must be dedicated to the County prior to issuance of the project's first <br />land development permit. <br />• 37th Street is classified as an urban arterial requiring 90' of ultimate right-of-way. <br />Since the project is located on the south side of the sub -lateral canal that separates the <br />site from 37th Street, no additional right-of-way is required for 37th Street with the <br />exception of a 40' corner clip at the corner of 58th Avenue and 37th Street.
