<br /> petent without proof of the due presentation and approval of
<br /> said code and ordinances.
<br /> Section 40. The City Council shall have power by ordinance
<br /> to provide the City and its inhabitants with water supply, sewer
<br /> system, electric light and power, gas for light and fuel, street
<br /> and other railways, telephone and telegraph lines, municipal
<br /> docks, seawalls along the water fronts of said City, bulkheads,
<br /> causeways, bridges, golf courses, air ports and other public utili-
<br /> ties, and for said purposes, or any of them, may buy, construct,
<br /> lease or otherwise acquire the same; and the City Council may
<br /> by ordinance permit any person or corporation to buy, construct,
<br /> lease or otherwise acquire and maintain any of said public utilities
<br /> for the purpose of furnishing the said City and its inhabitants
<br /> with service from the same; provided, however, that no exclusive
<br /> permission of franchises shall be granted to any person or corpora-
<br /> tion for any public utility. The City Council may by ordinance
<br /> make reasonable regulations as to the use of any public utility
<br /> and may Rx reasonable rates for service furnished by public utili-
<br /> ties to consumers.
<br /> Section 41. The City Council shall by ordinance provide for
<br /> the organization and maintenance of the Fire Department and
<br /> provide for the prevention and extinguishing of fires.
<br /> Section 42. The City Council shall have power to open, establish,
<br /> abolish, alter, extend, widen, grade, regrade, pave, repave or other-
<br /> wise improve, clean and keep in repair or rebuild streets, avenues,
<br /> alleys, sidewalks and crosswalks and other public ways and thor-
<br /> oughfares and construct, erect and keep in repair and rebuild
<br /> bridges, culverts, gutters, sewers and drains; to regulate and
<br /> provide for the construction, preservation and repair of streets,
<br /> avenues, alleys, sidewalks, foot pavements and other public ways
<br /> and thoroughfares and paving and repairing the same; to provide
<br /> for the construction of sewers and drains and for keeping the
<br /> same in repair; to provide for a uniform character of sidewalks
<br /> which shall be built upon a grade established by the City; to
<br /> take and appropriate private grounds, in manner and form pro-
<br /> vided by law for condemnation, for widening streets or parts '
<br /> thereof, or for extending the same, or for laying out new streets,
<br /> avenues, alleys, squares, parks or promenades; to grant the right-
<br /> of-way through the streets, alleys, avenues, and public grounds
<br /> of the City for the use of street or other railways, but the
<br /> owner of property abutting thereon shall not thereby be deprived
<br /> of any right he may have to claim any damage that he may receive
