CONSENT <br />INDIAN RIVER COUNTY, FLORIDA <br />MEMORANDUM <br />TO: Honorable Board of County Commissioners <br />THROUGH: Joseph A. Baird, County Administrator <br />THROUGH: John King, Director <br />Department of Emergency 9rvices <br />FROM: Dale Justice, Emergency Management Coordinator }� <br />DATE: February 11, 2014 <br />SUBJECT: Approval of State of Florida Request to Change a Word in the Federally <br />Funded 2013 Community Emergency Response Team (CERT) sub -grant # 14 -CI -K1- <br />10 -40 -02 -XXX. <br />It is respectfully requested that the information contained herein be given formal consideration by <br />the Board of County Commissioners at the next scheduled meeting. <br />DESCRIPTION AND CONDITIONS: <br />The State of Florida, Division of Emergency Management has requested a change in the <br />Federally Funded Community Emergency Response Team (CERT) grant contract that was <br />formerly approved by the Board of County Commissioners on January 7, 2014. The Division of <br />Emergency Management requests a slight revision to agreement on Page 4, Subsection (11) <br />REMEDIES, states, "If an Event of Default occurs, then the Division may after thirty calendar <br />days...Require the Recipient to reimburse the Division for the amount of costs incurred for any <br />items determined to be ineligible." The Division requests that the aforementioned verbiage be <br />revised to state, "If an Event of Default occurs, then the Division shall after thirty calendar <br />days...Require the Recipient to reimburse the Division for the amount of costs incurred for any <br />items determined to be ineligible." Please see the attachment included for your reference. The <br />Indian River County Attorney's Office has reviewed this request and recommends this item be <br />returned for Board approval. <br />FUNDING: <br />This is a 100% federally funded subgrant expenditure request consistent with the Florida Division <br />of Emergency Management directives. The Term of the Agreement is from September 01, 2013 <br />through September 30, 2014. An in-kind match is required from Indian River County which is <br />fulfilled with items such as donated equipment and volunteer hours. No Additional funding is <br />required. <br />77 <br />
