I <br />APR 101990 <br />BOOK J9 PAGE 91 <br />The Developer has taken issue with the above classification and has <br />requested reclassification under Section 6(c)26 of Ordinance 84-18, <br />which states the following: "In the event that a business or <br />structure is described in the schedule by general classification but <br />the particular nature of said business or structure would result in <br />an inequitable connection charge if the schedule were used, the <br />Utility in its discretion may determine that a higher or lower <br />number of units shall be used. Multiple use of an individual <br />structure or group of structures shall be classified to include all <br />uses." <br />TRTTT_V07C2 <br />The Department believes that the development would be correctly <br />rated under the current Ordinance 84-18 Section 6(c)21 as set out <br />above. This classification would require the Developer to pay the <br />following: <br />1. Payment of impact fees for 4 units - the minimum number of <br />units based upon the total building size - 20,070 <br />sq.ft./5,000 sq.ft. = 4 units, or payment for 16 units if <br />that is to be the ultimate utilization of the facility. <br />The Developer, through his attorney, requests relief under Section <br />6(c)26 (set out above), and proposes to pay for 3 units as outlined <br />in the attached Developers Agreement. <br />RECOMMENDATION <br />The Department of Utility Services recommends against the proposed <br />Developers Agreement and recommends the following: <br />The payment of impact fees for 4 units - the minimum number of <br />units based upon the total building size of 20,070 square feet <br />for each building until such time as the buildings are <br />constructed, leased and final determination of use is <br />available. <br />Commissioner Scurlock commented that this individual was <br />referred to him, and as the Board is aware, CH2M Hill has been <br />engaged to do an analysis of our existing rate structure, which <br />will include ERUs as well as connection charges, meters, etc. <br />Based on that he referred the individual to the Utilities Direc- <br />tor who has done an analysis on this particular item, and the <br />recommendation at this time is to charge the minimum and then <br />adjust it based on what the consultant comes back with in 90-120 <br />days, at which time we will be readdressing our fees. <br />Commissioner Bowman asked if the recommendation is payment <br />of impact fees for 4 units for each warehouse, or 8 units total. <br />Utilities Director Pinto explained that what we have is a <br />situation where in the construction of the building it has not <br />been determined how many individual storefront warehouses they <br />are going to build.
