There <br />is no category in here for that kind of use. At total build -out <br />each unit would have half a bath, and perhaps a fractional ERU <br />should be considered, but if they have to wait for the study, so <br />be it. <br />Commissioners Scurlock and Bird believed the Commission is <br />saying that there may be some problem with this category, but the <br />Commission cannot just pull a number out of a hat, and Attorney <br />Henderson stated that they are not asking the Board to settle on <br />a number today. <br />Commissioner Scurlock asked if Attorney Henderson had a <br />problem with a Motion for 4 & 4, which would be 8 units, and the <br />future to be determined by the CH2M Hill study which will be <br />available in 90- 120 days, and if they develop prior to that, <br />they will be charged whatever the impact fees are under this <br />ordinance. <br />Attorney Henderson stated the only problem they have with <br />that approach is that it presents his client with uncertainty at <br />this point in time. They have to wait out the study, and then it <br />is possible the rate might be the same or possibly even more. <br />Commissioner Bird noted that if it is more, they can spread <br />it over 5 years, but Attorney Henderson stressed that this is <br />simply a case where this category does not fit this use, and that <br />is what Section 26 is all about. <br />Chairman Eggert asked if anyone present wished to speak on <br />this matter. <br />Tom Furness, 75th St., expressed his belief that as the <br />county grows, we are going to have a need for the type of <br />building that FEDD is getting ready to do, and he believed we <br />need to come up with some way to charge these impact fees based <br />on the use; otherwise, you will discourage this quality type of <br />development. <br />i <br />18 <br />
