Commissioner Scurlock felt there needs to be a clarification <br />in the memo where it talks about negotiations with engineering <br />firms. He explained that actually we have done an RFP; there <br />have been 13 responses; and we are in the process of short <br />listing. It is not negotiation; it is a competitive request for <br />proposal process. <br />ON MOTION by Commissioner Scurlock, SECONDED by Com- <br />missioner Bird, the Board unanimously (4-0) approved <br />the North County Distribution System Water Main <br />Extension Project and authorized negotiations with <br />engineering firms for design of Phases I - III. <br />SETTLEMENT OF LAWSUIT REGARDING PROPERTY ON 6TH AVENUE <br />Asst. County Attorney Collins informed the Board that the <br />owner of the subject property, who is being foreclosed on, deeded <br />us a 5' strip of R/W on 6th Avenue. The bank that is doing the <br />foreclosing on the mortgaged property included us in the suit <br />because we were deeded the 51. The bank has offered to execute a <br />partial release of the mortgage over the 5' that was dedicated to <br />us if we agree we will never convey that 5' to a third party, <br />which could affect the access to the property. They also ask us <br />to indemnify and hold them harmless in the event we ever do <br />convey it to a third party. <br />Attorney Collins advised that it looks to him to be an easy <br />way out of a lawsuit and he would recommend we accept settlement, <br />which can be accomplished by authorizing him to sign a <br />Stipulation on behalf of the County. <br />ON MOTION by Commissioner Scurlock, SECONDED by Com- <br />missioner Bird, the Board unanimously (4-0) authorized <br />Attorney Collins to sign the Stipulation described <br />above. <br />APR 1 01990 87 BOOK 79 PACE 876 <br />
