Highlands agreement. He felt everyone is aware that General <br />Development Corporation is experiencing problems and has filed in <br />the courts. However, their utilities division (General <br />Development Utilities) is a wholly-owned subsidiary of General <br />Development Corporation and -,is not in bankruptcy. They are two <br />different entities, although they have a relationship by being <br />wholly-owned. Commissioner Scurlock wished to have authorization <br />for us to begin dialogue to get their attention so that we can, <br />in fact, take a position when it gets to court, because he felt <br />that the receiver is going to end up recommending disposal of <br />some assets. We certainly would like to acquire both of these <br />systems and make them a part of the County's system, but are <br />concerned that GDC might have to dispose of their utilities <br />division in whole. There is a concern that Topeka or some other <br />large utility might come in and place a bid to acquire the entire <br />system statewide. Commissioner Scurlock noted that there are at <br />least 3 or 4 unfriendly acquisitions taking place with General <br />Development in St. Lucie County to the south and Palm Bay to the <br />north. He felt it definitely would be in our interests for us to <br />acquire these as it would totally eliminate any private <br />franchises in the county. We have pretty firm agreements to <br />acquire the ones that are still out there, and we would end up <br />with two suppliers of water and sewer service to our county, the <br />County Utilities Division and the City of Vero Beach. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bird, the Board unanimously authorized <br />Commissioner Scurlock and Utilities Director Pinto to <br />pursue negotiations for acquisition of General <br />Development Utilities (GDU) both in the Vero <br />Highlands and Sebastian Highlands. <br />APR 17, 1990 41PAGE �`� 800 `�' <br />1�� � d' <br />
